These are the terms and conditions on which we provide in-person events, including, but not limited to, retreats, courses, workshops.

 

Please read these terms carefully before you place your booking with us. These terms tell you who we are, how we will provide our in-person events to you and how you and we may change or end the agreement. Other important information is also provided, including what to do if there is a problem. If you think that there is a mistake in these business terms, or if anything is unclear, please do not hesitate to contact us.

 

These Business Terms are the standard terms which apply to the services we provide to you  (known as the “Services”), by us, North Star Psychology Ltd, a limited company registered in England (company number 13777278) and whose registered address is Eastthorpe Hall, 23 Huddersfield Road, Mirfield, WF14 8AE.

 

BACKGROUND:

 

These Terms of Sale set out the terms under which the in-person event is sold by Us to business customers through this website, www.northstarpsychology.co.uk (“Our Site”) and/or our page on www.eventbrite.co.uk.  Please read these Terms of Sale carefully and ensure that you understand them before booking a place on the event. You will be required to read and accept these Terms of Sale when making your booking. If you do not agree to comply with and be bound by these Terms of Sale, you will not be able to purchase a place at the in-person event.

 

1.          Definitions and Interpretation

In these Terms of Sale, unless the context otherwise requires, the following expressions have the following meanings:

“Booking” – The booking made by the client with North Star Psychology Ltd & as detailed on the booking form.

“Booking Form” – The booking form that is completed by the client when booking an in-person event.

 

“Client” – The person, business or company who makes the booking with North Star Psychology Ltd.  All participants at in-person events must have a minimum age of 18 years.

“Contract” – The contract between the client and North Star Psychology Ltd, under which the services are provided by North Star Psychology Ltd to the client.

“Data Protection Legislation” means all applicable legislation in force from time to time in the United Kingdom applicable to data protection and privacy including, but not limited to, the UK GDPR (the retained EU law version of the General Data Protection Regulation ((EU) 2016/679), as it forms part of the law of England and Wales, Scotland, and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018); the Data Protection Act 2018 (and regulations made thereunder); and the Privacy and Electronic Communications Regulations 2003 as amended;

“Fee” – The amount payable to North Star Psychology Ltd under the contract.

“Order Confirmation” means Our acceptance and confirmation of your purchase of an online course or webinar.

“Our site” – The website of North Star Psychology Ltd: www.northstarpsychology.co.uk

“Payment” – The total fee is due at the time of booking the in-person event.  

“Recordings” – Photographs, videos, or any other audio visual recordings taken of participants during the in-person event.

“We/Us/Our” Means North Star Psychology Ltd  a company registered in England under 13777278 whose registered address is Eastthorpe Hall, 23 Huddersfield Road, Mirfield, WF14 8AE.

 

2.          Information About Us

2.1        Our website is owned and operated by North Star Psychology Ltd, a limited company registered in England under 13777278 whose registered address is Eastthorpe Hall, 23 Huddersfield Road, Mirfield, WF14 8AE.

2.2        Dr Rachel Lee, the director of North Star Psychology Ltd, is registered with the United Kingdom’s Health and Care Professions Council, (HCPC).

2.3        Dr Rachel Lee is also chartered by the British Psychological Society https://www.bps.org.uk/  and abides by their code of Ethics and Conduct, https://www.bps.org.uk/news-and-policy/bps-code-ethics-and-conduct

 

3.          Access to and Use of Our Site

3.1        Access to Our Site is free of charge.

3.2        It is your responsibility to make any and all arrangements necessary in order to access Our Site.

3.3        Access to Our Site is provided “as is” and on an “as available” basis.  We may alter, suspend or discontinue Our Site (or any part of it) at any time and without notice.  We will not be liable to you in any way if Our Site (or any part of it) is unavailable at any time and for any period.

3.4        Use of Our Site is subject to our Privacy Policy (see www.northstarpsychology.co.uk/privacypolicy).  Please ensure that you have read this carefully and that you understand the details.

 

4.          Content and Pricing

4.1        The details of the in-person event and its corresponding price will be set out on the relevant page of Our Site and/or on our page on Eventbrite.

4.2        We may from time to time change Our prices.  Changes in price will not affect any purchase that you have already made, but will apply to any subsequent purchases. 

4.3        Unless otherwise indicated, Dr Rachel Lee owns the copyright for the content presented during the event and in supporting documentation. The content should not be recorded or reproduced. Accompanying documentation must also not be shared or reproduced.

4.4        Any handouts provided are for personal/non-commercial use only. The content must not be modified or republished in any form without the prior consent of the author. If you seek to reproduce or otherwise use the content in any way it is your responsibility to obtain approval for such use where necessary. Any breach of copyright, including recording the event or any unauthorized use of the material may lead to legal action.

 

4.5        North Star Psychology Ltd is not liable for the detailed content of any events, the quality of presentation or if the learning outcomes or experience of attending did not completely meet expectations.

 

4.6        In-person events and materials may refer to other websites over which North Star Psychology Ltd has no control. North Star Psychology Ltd does not take responsibility for the accuracy of information contained on those websites and is not are not liable for the content on those websites.

 

4.7        We make all reasonable efforts to ensure that all prices shown on Our Site are correct at the time of going online.  Changes in price will not affect any order that you have already placed.

 

4.8        If the price of an in-person event that you have booked changes between your order being placed and Us processing that order and taking payment, you will be charged the price shown on Our Site at the time of placing your order.  Subsequent bookings will be charged at the new price.

 

4.9        Prices on Our Site are shown exclusive of VAT.

 

5.          Orders – How Contracts Are Formed

5.1        Our Site will guide you through the process of purchasing the in-person event.  Before completing your purchase, please ensure that you have checked your order carefully before submitting it.

5.2        If, during the order process, you provide Us with incorrect or incomplete information, please contact Us as soon as possible.  If We are unable to process your order due to incorrect or incomplete information, We will contact you to ask to correct it.  If you do not give Us the accurate or complete information within a reasonable time of Our request, We will cancel your order and treat the Contract as being at an end.  We will not be responsible for any delay in booking your place that results from you providing incorrect or incomplete information.

5.3        No part of Our Site constitutes a contractual offer capable of acceptance.  Your order to purchase a place at an in-person event constitutes a contractual offer that We may, at Our sole discretion, accept.  Our acceptance is indicated by Us sending you an Order Confirmation by email.  Only once We have sent you an Order Confirmation will there be a legally binding Contract between Us and you.

5.4        Order Confirmations shall contain the following information:

5.4.1    Your Order ID;

5.4.2    Confirmation of the order including the name of the event, time and date.

5.5        In the unlikely event that We do not accept or cannot fulfil your order for any reason, We will explain why in writing.  No payment will be taken under normal circumstances.  If We have taken payment any such sums will be refunded to you.

5.6        Any refunds due under this Clause 6 will be issued to you as soon as possible, and in any event within 14 calendar days of the day on which the event triggering the refund occurs.

5.7        Refunds under this Clause 6 will be made using the same payment method that you used when purchasing your Subscription.

 

6.          Provision of the In-person Event

6.1        We undertake to make available to You on these Terms of Sale a place at the in-person event you have booked onto.  However, if You choose not to attend, for any reason not attributable to Us, You will not be entitled to any refund.

6.3        We will use reasonable endeavours to make the in-person event available and start it at the time it is scheduled to start, but the start may be delayed by events out of our of our control (see section 13) or by other circumstances. We will not be liable for any such delay.

6.5        Participants are not authorised to record, live stream or make a transcript of the in-person event under any circumstances.

 

7.          Payment

7.1        Payment for the in-person event must always be made in advance at the time of booking.  Your chosen payment method will be charged when your order is processed. You will then receive an order confirmation.

7.2        Payments due must be made in full, without any set-off, counterclaim, deduction, or withholding (except where any deduction or withholding of tax is required by law).

7.3        We accept all major debit and credit cards.

7.4        If you believe that We have charged you an incorrect amount, please contact Us at info@northstarpsychology.co.uk as soon as reasonably possible to let Us know.  You will not be charged for Content while availability is suspended.

 

8. Responsibility of the client

8.1 The fee does not include travel to and from the in-person event location where the proposed services shall be provided. Travel costs will be the sole responsibility of the client. The fee does not include any required accommodation, accommodation costs will be the sole responsibility of the client.

8.2 The client is responsible for their own personal medical needs or requirements, clothing & footwear for the duration of the services.

8.3 It is the client’s responsibility to inform North Star Psychology in writing of any past, present or potential health issues that may make them unsuitable to participate in any aspect of the in-person event.

 

9. Changes and amendments.

9.1 North Star Psychology Ltd reserves the right to change any price or other particulars of the in-person event before the contract becomes binding.

9.2 If there is a major change to the content or other aspect of the in-person event, North Star Psychology Ltd will notify the client as soon as possible. North Star Psychology Ltd will seek to offer the client new arrangements that are as close to the original as is reasonably possible in the circumstances.

9.3 If there is any change other than a major change, North Star Psychology Ltd is not obliged to inform the client in advance or obliged to pay any compensation.

9.4 If changes are made by the venue North Star Psychology Ltd cannot be held responsible for any such changes, as these are out of their control.

 

10         Cancelling your in-person event

10.1     You may cancel your in-person event at any time.

10.2  Any cancellation of the contract will incur the cancellation charges detailed below. The cancellation charges are based on the number of days between the sent date of the email informing us of the cancellation and the start date of the in-person event.

Less than 8 weeks: 100% of the cost of the in-person event will be retained by North Star Psychology Ltd
Less than 12 weeks: 50% of the cost of the in-person event will be retained by North Star Psychology Ltd
More than 12 weeks: 25% of the cost of the in-person event will be retained by North Star Psychology Ltd.

10.3     If you wish to exercise your right to cancel under this Clause 11, you must inform Us of your cancellation by email.  Cancellation by email is effective from the date on which you send Us your message. If you would prefer to contact Us directly to cancel, please use the following details:

In each case, provide Us with your name, address, email address, telephone number, and Order ID.

10.4     Refunds under this Clause 11 will be issued to you as soon as possible, and in any event within 14 calendar days of the day on which you inform Us that you wish to cancel.

10.5     Refunds under this Clause 11 will be made using the same payment method that you used when purchasing your Subscription.

 

11         Ending the Contract Because of Something We Have Done (or Will Do)

 

11.1 North Star Psychology Ltd will always aim to fulfil confirmed bookings. We reserve the right to cancel a scheduled in-person event. If We cancel a booking prior to the commencement of the in-person event,  the client will be offered an alternative date, or where applicable a full refund of all monies paid by the client up to that point (minus credit card charges & third party commission where applicable ) for the specified event. *The exception being that: if the cancellation is due to “events outside of our control” or “force majeure” (see section 14).

11.2     If you wish to exercise your right to cancel under this Clause 12, you may inform Us of your cancellation in any way you wish.  Cancellation by email or by post is effective from the date on which you send Us your message. If you would prefer to contact Us directly to cancel, please use the following details:

In each case, providing Us with your name, address, email address, telephone number, and Subscription ID.

11.3     Refunds under this Clause 11 will be issued to you as soon as possible, and in any event within 14 calendar days of the day on which you inform Us that you wish to cancel.

11.4     Refunds under this Clause 11 will be made using the same payment method that you used when purchasing your Subscription.

 

12         Our Liability

12.1 Neither North Star Psychology Ltd nor any of its Directors, employees or agents will be liable for any loss or damage to any personal property or vehicle belonging to the client during attendance at the in-person event.

12.2     The client understands that attending any in-person event offered by North Star Psychology Ltd involves some level of risk. These risks include but are not limited to physical injury or even death. Subject to sub-Clause 13.4, by attending and participating in any in-person event provided by North Star Psychology Ltd the client agrees to assume these risks & agrees to release & discharge North Star Psychology Ltd & its Director, employees & agents from any & all claims for liability.

12.3     Subject to sub-Clause 13.4, Our total liability to you for all other losses arising out of or in connection with any contract between you and Us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be 100% of the total sums paid by you under the contract in question.

12.4     Nothing in these Terms of Sale seeks to limit or exclude Our liability for death or personal injury caused by Our negligence (including that of Our employees, agents or sub-contractors); for fraud or fraudulent misrepresentation; or for any other matter in respect of which liability cannot be excluded or restricted by law.

12.5     Disclaimer: None of our Content constitutes advice on which you should rely.  It is provided for informational and educational purposes only.  We do not make any representation or warranties with respect to the accuracy, applicability, fitness or completeness of any of our Content. The information in the Content represents the views and opinions of the original creators of such Content and does not necessarily represent the views or opinions of Us.  We disclaim any and all liability to you for any direct, indirect, implied, punitive, special, incidental or other consequential damages arising directly or indirectly from any use of the Content, which is provided as is and without warranties.

 

13         Events Outside of Our Control (Force Majeure)

13.1     We will not be liable for any failure or delay in performing Our obligations where that failure or delay results from any cause that is beyond Our reasonable control.  Such causes include, but are not limited to: power failure, failure of a utility service or transport network, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, malicious damage, accidents, storms and adverse weather, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, breakdown of machinery, failure to deliver from suppliers or subcontractors, or any other event that is beyond Our reasonable control.

 

13.2     If any event described under this Clause 14 occurs that is likely to adversely affect Our performance of any of Our obligations under these Terms of Sale:

13.2.1 We will inform you as soon as is reasonably possible;

13.2.2 We will take all reasonable steps to minimise the delay;

13.2.3 To the extent that We cannot minimise the delay, Our affected obligations under these Terms of Sale (and therefore the Contract) will be suspended and any time limits that We are bound by will be extended accordingly;

13.2.4 We will inform you when the event outside of Our control is over and provide details of any new dates, times or availability as necessary;

13.2.5 If the event outside of Our means that we need to cancel the booking We will cancel the Contract and inform you of the cancellation.  Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible and in any event within 14 calendar days of the date on which the Contract is cancelled and will be made using the same payment method that you used when booking your event.

 

14. Recordings

14.1 North Star Psychology Ltd reserve the right to take any photographs or recordings of the client during the in-person event and the client accepts that all rights whatsoever arising in the recordings shall be solely owned by North Star Psychology Ltd. The client accepts & agrees that any photographs or recordings may be used by North Star Psychology Ltd on its website, social media channels, promotional material & advertisements.

 

15. Third party websites and services

15.1 North Star Psychology Ltd may employ the services of other parties for dealing with matters that may include, but are not limited to, payment handling, delivery of purchased items, search engine facilities, advertising  and marketing. The providers of such services will have access to the specific personal data provided by users of our website that is required for the other party to provide the required service.

16         How We Use Your Personal Information (Data Protection)

16.1     All personal data that We may use will be collected, processed, and held in accordance with the provisions of the Data Protection Legislation and your data privacy rights.

16.2     For complete details of Our collection, processing, storage, and retention of personal data including, but not limited to, the purpose(s) for which personal data is used, the legal basis or bases for using it, details of your rights and how to exercise them, and personal data sharing (where applicable), please refer to Our Privacy Policy (www.northstarpsychology.co.uk/privacypolicy) which includes our Cookie Policy.

 

17         Other Important Terms

17.1     The Contract is between you and Us.  It is not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms of Sale.

17.2     If any of the provisions of these Terms of Sale are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed severed from the remainder of these Terms of Sale.  The remainder of these Terms of Sale shall be valid and enforceable.

17.3     No failure or delay by Us in exercising any of Our rights under these Terms of Sale means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms of Sale means that We will waive any subsequent breach of the same or any other provision.

17.4     We may revise these Terms of Sale from time to time in response to changes in relevant laws and other regulatory requirements.  If We change these Terms of Sale as they relate to your booking, We will give you reasonable advance notice of the changes and provide details of how to cancel if you are not happy with them (also see sub-Clause 12 above).

 

18         Law and Jurisdiction

18.1     These Terms of Sale, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with, English law.

18.2     Any disputes concerning these Terms of Sale, the relationship between you and Us, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England and Wales.
